Privacy Policy

This Privacy Policy describes how the Company treats Personal Data (as defined in the EU general data protection regulation 2016/679, or “GDPR”) that you provide to us, including how we are Processing (as defined in the GDPR) such information, how we protect the security of such information, and how you may change or request that we amend such information from our systems.

Collection, Processing and Use of Personal Data

The Company respects your privacy, and is committed to complying with applicable privacy laws in those jurisdictions where we do business. The Company needs to collect your Personal Data, and it must undergo Processing in order to perform necessary ancillary activities related to our commercial business relationships. If you or your employer decide to purchase our goods or services, we will use your Personal Data for purposes of communicating with you.

Legal Basis

The Company is Processing your data based on legitimate interest, defined in the GDPR as “there is a relevant and appropriate relationship between” you or your employer and our Company.

Data Categories

The categories of Personal Data that we are Processing include: first and last name, title, position, employer/company name, contact information such as email-addresses, phone numbers, facsimile numbers, physical business address, and other contact information depending on the Data Subject’s communications preferences (e.g. a Skype® address).

The Processing of the Personal Data that we have collected from you involves electronic storage in a cloud computing contact management software and our use of it to communicate with you.

Access to your Personal Data

In order for Processing in connection with current communications with you, your Personal Data may be shared and accessed by authorized personnel within our Company. Additionally, your Personal Data may be transferred to and/or accessible by authorized personnel within the Company in countries other than your home country, specifically Canada and/or the USA. The Company will ensure that your Personal Data is protected. Authorized personnel permitted to access your Personal Data are obliged to maintain data secrecy and confidentiality. The Company has implemented appropriate technical, organizational, and physical measures to protect your Personal Data, in particular against accidental or unlawful disclosure. Your Personal Data will not be released to third parties without your consent (in writing or electronically), or unless otherwise required or allowed by law.

Data Retention

Your Personal Data will be retained only for as long as we need it to fulfil the purpose for which we have collected it and, if applicable, as long as required by statutory retention requirements.

Your Rights

If you are a resident of the EEA, you have certain rights regarding our use of your Personal Data. Some of these rights, e.g., the right to be forgotten will only apply in certain circumstances. Generally, these rights will not be available if there are current contracts between us, if we are required by law to keep the information or if the information is relevant to a legal dispute.

The rights you have over your Personal Data are listed in Articles 15 through 21 of the GDPR. These rights are subject to restrictions under European data protection law and, subject to the exemptions in that law, may only apply to certain types of information or Processing.

You also have a right to object to us Processing your information in certain circumstances.  You can ask us to stop Processing your information at any time. In certain circumstances we may not be able to do this or may not be required to do this. For example, if there are current contracts between us, if we are required by law to keep the information or if the information is relevant to a legal dispute then we may not stop Processing your information.
